Prosecutors in Caleb County, have asked once again that the West Virginia Supreme Court rule on whether former Marshall football player, Steward Butler can be charged with a hate crime. Butler had attacked two men after seeing them kiss, but a judge had ruled last month that he could not be charged with a hate crime because it appears that state lawmakers intended to leave protections based on sexual orientation out of the law. Prosecutors have filed another appeal on Thursday and hope the Supreme Court will hear the case.
